Welcome. These Terms of Service (“Terms”) govern your access to and use of allieandpat.com and any orders you place with Allie & Pat (“we,” “us,” “our”). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By placing an order you represent that the payment method and shipping address you provide are yours or that you have authorization to use them.
2. Your account
You are responsible for keeping your account credentials safe and for all activity under your account. Notify us promptly at hi@allieandpat.com if you believe your account has been used without authorization.
3. Orders and pricing
- All prices are in U.S. dollars and shown on the product page at checkout. We may change prices at any time, but the price you see at the moment of checkout is the price you pay for that order.
- We may correct typographical errors, decline an order, or limit quantities at our discretion. If we cancel an order after charging you, we will issue a full refund.
- Sales tax is calculated at checkout based on your shipping address and applicable law.
4. Payment
Payments are processed by Stripe. You authorize us (and Stripe) to charge your selected payment method for the order total, including shipping and tax. We never store your full card number on our servers.
5. Shipping and risk of loss
Shipping terms are described on our Shipping Policy. Title and risk of loss pass to you when the carrier hands the package to you (or marks it as delivered).
6. Returns and refunds
Return and refund eligibility is described on our Returns Policy.
7. Digital products and courses
We may offer digital products, including online courses with video lessons and quizzes. Buying a course gives you a personal, non-transferable, non-exclusive license to access that course's content through your account for your own learning. It does not transfer ownership, and you may not download, copy, share, resell, or publicly show the content except as the Site expressly allows.
- Access is delivered to your account after payment. Courses are not physical goods, so the Shipping Policy does not apply to them.
- Because course content is delivered digitally and consumed immediately, course purchases are generally non-refundable once you have accessed the material, except where required by law. If you have a problem with a course, email hi@allieandpat.com and we will try to make it right.
- We may add, update, or retire course content over time, and we may suspend or revoke access for a violation of these Terms.
8. For Kids By Kids
Artwork sold under our For Kids By Kids program is created by minor artists with written parental or guardian consent. 100% of the profit from each piece (after print, packaging, shipping, and payment processing costs) is paid to the young artist or their designated guardian account. We retain the right to remove any piece from sale at our discretion.
9. Acceptable use
You agree not to:
- Use the Site to break the law or harm anyone.
- Reverse engineer, scrape, or interfere with the Site's systems.
- Submit fraudulent orders or chargebacks.
- Upload or transmit anything illegal, infringing, harassing, or otherwise objectionable.
We may suspend or terminate accounts and refuse service for any violation of these Terms.
10. Intellectual property
The Site, our brand (“Allie & Pat,” logos, copy, design), and all content we publish are owned by us or our licensors and are protected by copyright, trademark, and other laws. You may not copy or republish the Site or our content without our written permission, except as permitted by fair use.
Artwork uploaded under For Kids By Kids remains the property of the young artist or their guardian; we are licensed to print, sell, and promote it.
11. Third-party links
The Site may link to TikTok, Instagram, Rise Against Hunger, and other third-party sites. We are not responsible for those sites or their privacy practices. Following an outbound link is at your own risk.
12. Disclaimers
The Site and our products are provided “as is” and “as available,” without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.
13. Limitation of liability
To the maximum extent permitted by law, Allie & Pat will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or in connection with your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
14. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
15. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
16. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after we post changes means you accept the updated Terms.
